for the Business Navigator platform (businessnavigator.app) operated by INREMA Unternehmensberatung GmbH
Effective: April 2026 (v2.0)

This is a translation of the German original. In case of any discrepancy between language versions, the German version shall prevail. The binding German version is available at businessnavigator.app/agb.

1. Provider

2. Scope

These Terms govern all agreements between INREMA Unternehmensberatung GmbH (the "Provider") and its customers regarding the use of the Business Navigator SaaS platform. The platform is primarily intended for entrepreneurs, self-employed professionals, freelancers and founders.

3. Subject Matter

Business Navigator is a Software-as-a-Service platform providing digital tools (online presence, communication, invoicing, AI-assisted business diagnostics). Access is online-only through the cockpit on businessnavigator.app.

4. Registration and Account

Use requires registration. The customer must provide truthful information. Credentials must be kept confidential. Account-sharing is prohibited.

5. Plans and Pricing

A free plan and paid "Pro" plans are offered. Prices are in EUR, excluding statutory VAT where applicable. Payment is in advance per billing cycle. Third-party payment providers (e.g. Stripe) may be used.

6. Term and Termination

Paid plans renew automatically unless cancelled at least one day before the current term ends. Cancellation is via the account cancellation function. Pro access remains until the end of the paid term; no pro-rata refund applies unless required by law.

7. Account Deletion — 7-Day Model

Account deletion is requested via account settings and proceeds in two confirmation steps. After final confirmation, access is suspended immediately; all data is permanently deleted after 7 days. A reactivation link valid 7 days is emailed. Invoicing data is retained 10 years; consent records 3 years (Art. 6(1)(f) GDPR).

8. Customer Obligations

The customer is solely responsible for all content they create, upload or publish. The customer is solely responsible for their own legal notice and for compliance with applicable laws in their jurisdiction (copyright, personality rights, competition law, data protection, advertising).

9. Availability

The Provider strives for high availability but does not owe uninterrupted, error-free service. Customers are responsible for suitable internet connection and up-to-date hardware/software.

10. Data Protection and DPA

Processing of the customer's personal data is governed by our Privacy Policy. Where the Provider processes personal data of third parties on behalf of the customer, our Data Processing Agreement (DPA) applies.

11. Warranty and Liability

DISCLAIMER OF WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

LIMITATION OF LIABILITY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY THE CUSTOMER DURING THE 12 MONTHS PRECEDING THE CLAIM.

Nothing herein excludes liability that cannot lawfully be excluded, including intent, gross negligence, injury to life/body/health, or under any non-waivable statutory right.

12. DMCA — Copyright Notices

The Provider complies with 17 U.S.C. § 512. Designated DMCA agent: INREMA Unternehmensberatung GmbH, DMCA Agent, Rentmeister-Wilthelm-Weg 16, 33181 Bad Wünnenberg, Germany. Email: dmca@businessnavigator.app. Repeat infringers' accounts will be terminated.

13. Governing Law, Jurisdiction, Language

These Terms are governed exclusively by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Exclusive place of jurisdiction for merchants is Paderborn, Germany. The contract language and binding legal language is German.

CLASS ACTION WAIVER. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ANY DISPUTE SHALL BE RESOLVED SOLELY ON AN INDIVIDUAL BASIS. THE CUSTOMER WAIVES ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING AGAINST THE PROVIDER.

14. Final Provisions

If any provision becomes invalid, the remaining provisions are unaffected. These Terms constitute the entire agreement regarding their subject matter.
